Acceptable Use Policy

Mountain Tower and Network Company, LLC., hereinafter referred to as BEACON strives to provide its customers with the highest quality Internet service that is available and at the same time respect the standards that have been created within the Internet community. To that end BEACON believes that certain activities and conduct are inappropriate or abusive and will not be tolerated on BEACON’s network. This list is not meant to be exhaustive, but merely illustrative of examples of conduct deemed by BEACON to be inappropriate and improper and therefore prohibited on BEACON’s network.

BEACON’s network may only be used for lawful purposes. The transmission of material that is in violation of any federal, state or local law, or that is protected by trademark, trade secret or other intellectual property is strictly prohibited.

Customers are prohibited from using the BEACON’s network to transmit material that is judged by BEACON to be illegal, proprietary, obscene, criminal or in some fashion inconsistent with the generally accepted standards of the Internet community.

BEACON has zero tolerance for the use of its network by anyone for the distribution of unsolicited bulk commercial e-mail transmissions.

BEACON may offer limited and unlimited bandwidth usage but reserve the right to cancel service of any customer whose usage is determined to be excessive at the sole discretion of BEACON.

BEACON also has zero tolerance for the use of its network for the posting of messages or commercial advertisements which violate the rules, regulations, FAQ or charter of any newsgroup or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.

BEACON reserves the right to cancel or alter services of any customer who has been found to create problems with the use of the BEACON network that affects other BEACON customers.

Anyone who publishes materials and information which are accessible through BEACON’s network is solely responsible for the content of such materials and information and is solely responsible to know and comply with all laws applicable to the publication and distribution of such materials and information. BEACON does not accept responsibility for the content of the materials and information published by others which is accessible through the BEACON network and does not accept responsibility for the violation of any laws resulting from such publication or distribution.

BEACON is an access provider and as such exercises no control over the content of the information passing through its network. It is expected that BEACON’s customers will comply with whatever rules or Acceptable Use Policies that are appropriate for those networks accessed through BEACON. Each BEACON customer accepts the responsibility to avoid whatever material it finds offensive. If any BEACON customer interferes with other’s use and enjoyment of the services provided by BEACON, such customer shall be deemed to be in violation of this Acceptable Use Policy.

Each customer of BEACON must ensure that its own family members, employees, or customers do not act in a way that violates BEACON’s Acceptable Use Policy. BEACON customers are expected to bring their customers into compliance with BEACON’s Acceptable Use Policy or risk their service being discontinued.

BEACON is solely responsible for determining if a violation of the Acceptable Use Policy has occurred. Even though BEACON does not review or censor materials and information which is accessible on BEACON’s network or other networks which may be connected to BEACON’s network, if BEACON becomes aware that one of its customers is in violation of this Acceptable Use Policy, BEACON reserves the right to suspend or terminate service without notice. In addition, BEACON reserves the right to interpret this Acceptable Use Policy in its sole discretion and to amend, revise, add or delete any provision of this Acceptable Use Policy.
